Abstract

The continuous advancement of artificial intelligence technology has triggered many controversies. In the field of AI text-generated images, the current controversy focuses on the issue of copyrightability and attribution of rights. This paper takes the case of "Spring Breeze Sends Tenderness" as an entry point, and concludes that when the user has made certain influence and personalized choices on the final output of the image, and the user has made substantial contributions in the process of generating the image, it can be considered that the relevant AI text-generated image constitutes a work in the sense of the copyright law, and its rights are attributed to the user.
